Xbox kinect sensor

Rule <R02> part D says that exposed lasers of any type are not permitted. We are considering using the new XBox Kinect sensor: http://en.wikipedia.org/wiki/Kinect. This sensor works by projecting a structured infra-red light field generated by a source that could be considered to be a laser. Is the Kinect legal for FIRST FRC?
